Sales ban against Samsung Tab to be reconsidered
 

Things are not going Apple's way after all in the Land of the Fee after a US appeals court ruled that a lower court should reconsider a sales ban against Samsung's Galaxy Tab 10.1.

Apple won the sales ban in a patent dispute with the South Korean electronics maker just before it "won" a trial against Samsung.

At the time we at the all-seeing TechEye said that the victory was going to be unravelled in the appeal process, partly because it requires people to believe that Apple invented the rounded rectangle and partly because the badshit crazy jury foreman admitted ignoring the law completely.

But even with that stacked against it, Samsung was found not to have violated the patent that was the basis for the tablet injunction and Samsung argued the sales ban should be lifted.

US District Judge Lucy Koh said she could not act because Samsung had already appealed.

According to Reuters, the Federal US Circuit Court of Appeals in Washington said Koh could now consider the issue with its blessing.

The Galaxy 10.1 is an older model, Samsung still wants it in the shops in the run-up to Christmas shopping.
