Apple has filed a new complaint against Samsung before a German court in Dusseldorf. The claim alleges that Samsung’s Galaxy Tab 10.1N too closely resembles the iPad, despite the fact it was redesigned to specifically address Apple’s concerns, following an earlier ruling in Apple’s favour.

Apple lawyers maintain that the changes were too little too late.

“Samsung added some loudspeakers and made the sides a bit thicker, but that can’t be it,” said lawyer Matthias Koch.

Samsung tried to defend itself by commissioning a poll, which revealed that Galaxy Tab buyers did not choose the tablet because it resembled the iPad, to make other people think they actually got an iPad. However, the presiding judge said the survey was of little value, as buyers simply would not admit buying a cheaper device to make others believe they own a premium device.

Apple also used the latest hearing to petition the court to extend its ban against Samsung’s Galaxy Tab 7.7, although people blessed with the sense of sight could hardly mistake it for an iPad.

According to Bloomberg, if the court finds Samsung in violation of EU design rights, it has the power to impose an EU-wide ban.
