The Gaia project, an open source 3D earth viewer, has been served with a cease and desist order from Google. Google feels that the Gaia project is reverse engineering and improperly using licensed Google Earth data. The letter and reply is posted on the Gaia page.

The Gaia project was delivered a C & D order from Michael Jones, Chief Technologist of Google Earth, Maps, and Local Search. The original letter was polite, and did a pretty good job explaining the project violates the Google Earth TOS.
