Samsung kicks Apple in the Netherlands

Samsung Electronics has won its first major court victory in its global patent dispute with Jobs' Mob.

According to the Wall Street Journal, a court in The Hague told Apple to pay damages for infringing a technical communications patent in some of its mobile devices, including the iPhone 3G, 3GS, 4 and iPad 1 and 2.

It will take two months for the damages to be calculated and so Samsung should be fairly happy.

However the court threw out Samsung's claims for damages for a further three technical patents.

Appeal, sorry Apple, is still thinking about whether it will appeal. There are some risks if it does so.

Jobs' Mob started the fight against the Korean company in April 2011 for allegedly copying the designs of its iPhone and iPad products.

This ruling will not end the dispute world wide, but might be the legal equivalent of banging both sides' heads together.

Florian Mueller said that it is not clear if Samsung will make enough money as a result of this infringement finding to offset the €800,000 it now owes Apple in legal fees because it lost with respect to three of its four patents.

Apple and Samsung have around 30 patent litigation cases against each other in around 10 countries.

It has been a bad week for Jobs' Mob an Australian federal court judge ordered Apple to pay $2.29 million fine for lying to customers about the capabilities of its new iPad tablet.

Apple's branding implied that the newest version of the iPad implied it could connect with Aussie fourth generation mobile networks in Australia, when it couldn't.
