Filtering failure: Belgian ISP gets reprieve from court
 
Belgian Internet Service Provider Scarlet won a small victory in the ongoing legal battle between the ISP and Belgian copyright holders representative SABAM. Scarlet will not have to pay €750,000 in penalties for failure to comply with a court order to implement peer-to-peer filtering of copyrighted material.

SABAM fullfills a role similar to the Harry Fox Agency in the US by collecting licensing fees on behalf of copyright holders of all kinds in Belgium. In 2004, the group filed a suit against Scarlet (known as Tiscali at the time), demanding that the ISP implement technical measures to make sure that its customers wouldn't share materials infringing on the copyrights of SABAM members through peer-to-peer networks.
